COVID-19 Emergency Eviction & Foreclosure Prevention Act of 2020

Today, both the Senate and the Assembly enacted S.9114 (Kavanaugh)/ A.11181 (Dinowitz), referred to as the “COVID-19 Emergency Eviction and Foreclosure Prevention Act of 2020.”    In sum, the bill makes various temporary changes to eviction, mortgage foreclosure, and tax foreclosure proceedings, prohibits credit discrimination, and extends certain tax exemptions from local assessment rolls.  It is important to note that the bill specifically does not “cancel rent” or eliminate late fees.  Tenants who file the hardship declaration discussed below remain responsible for payment of the rent owed and late fees.
